Incentives, Rebates OK If Rules Are Followed

In addition to the rules mentioned in the holiday season reminder that appeared last month in “Legally Speaking,” permit holders should also be aware of the requirements of Rule 45 that may also be used in connection with holiday sales.

Rule 45 states that unless authorized under R.C. Chapter 4301 or 4303, or the rules adopted and promulgated thereunder, “no merchandise or thing of value shall be given away in connection with the purchase of an alcoholic beverage.”
