Court: Certified Troopers May Use Multiple Alcohol Breath Tests

COLUMBUS — A Franklin County appellate panel recently ruled that a state trooper who has the proper certification to use multiple breath tests may use any of the machines to which he or she has access when conducting an alcohol test.

The 10th District Court of Appeals sustained the state’s argument that a trooper certified to use two breath tests properly used one of them to assess an OVI suspect’s intoxication levels.
