Court: 'Good Cause' Must Exist To Deny Permit
Published: 01/15/2013
The Tenth Appellate District issued a decision on Dec. 28 that all permit holders and people seeking liquor permits should be aware exists.
The decision is Downtown Cronton, Inc. v. Liquor Control Comm. and involves an objection to a transfer of a class D-5 permit. Procedurally, the city of Cleveland objected to the transfer and the Division of Liquor Control sustained the objection. On appeal, both the Liquor Control Commission and the common pleas court affirmed the objection.
