Another Court Upholds State Control Over Al-Bev

The U.S. Court of Appeals for the Sixth Circuit released its opinion in Maxwell’s Pic-Pac v. Dehner, and in doing so upheld Kentucky’s long-standing prohibition on wine and liquor sales in grocery stores and gas stations.

The court held it serves a legitimate purpose and doesn’t violate the equal protection clause of the 14th Amendment to the U.S. Constitution and that the district court had misapplied the appropriate standard for an equal protection challenge.
